Terms of Sale of Registration Number Rights
1. What happens when you submit an application
By submitting this application, you are asking VicRoads to sell you registration number rights to the registration number nominated by you and issue a number plate or plates bearing the registration number.
VicRoads does not have to accept your application and may reject it for any reason including that the registration number is offensive, a risk to security or otherwise inappropriate for public display.
If VicRoads does not accept your application, it will refund your application money by bank cheque or other agreed method using the name and address details provided by you. Additional information may be required if VicRoads agrees to refund your application money other than by bank cheque.
Your application is not accepted unless and until VicRoads has issued the number plate or plates to you.
You can change or cancel your application until VicRoads has issued the number plate or plates to you by contacting VicRoads on 1300 660 417. You will not be charged a fee if you do so prior to VicRoads commencing to manufacture the number plate or plates. Otherwise, you will be charged an amount equal to the replacement plate fee for the type of number plate or plates you originally applied for.
2. What are you applying to purchase
You are applying to purchase "registration number rights", not the number plate or plates themselves. Number plates always remain the property of the State of Victoria. If your application is accepted, this means no one else can display a number plate or plates bearing that registration number without your permission. As owner of the registration number rights, you can:
- Have the registration number assigned to a vehicle registered in your name (or, with your consent, any other vehicle registered by VicRoads), but not if it is a licensed vehicle such as a hire car, taxi, tow truck or hire motorcycle.
- Display a number plate or plates bearing that registration number on any vehicle to which that number is assigned by VicRoads or, alternatively, store the number plate or plates in your possession without having the registration number assigned to a vehicle.
- Transfer these rights to someone else.
However, these rights are subject to the other matters outlined below.
3. Cancellation of Registration Number Rights and Recall of Plates
You agree to VicRoads cancelling the registration number rights and recalling the number plate or plates at any time. For example, VicRoads might do so if it any time after it approves your application it decides that a particular registration number is offensive, a risk to security, incorrectly issued; or otherwise inappropriate for public display.
If VicRoads does so, it will offer you a refund (see below) but is not otherwise liable for any loss or damage this causes you.
If VicRoads notifies you that your registration number rights are cancelled, you must immediately return the number plate or plates to VicRoads. If you do not comply and VicRoads incurs expense in recovering the number plate or plates, you will be liable for those expenses.
You may choose to receive a refund of the fees originally paid to VicRoads in respect of the cancelled registration number rights, or may apply to purchase registration number rights to a different registration number. If you apply and VicRoads accepts your application:
- If the fees payable in respect of the new registration number rights are more than those fees paid in respect of the cancelled registration number rights, you must pay the difference (together with any recovery expenses VicRoads incurs).
- If the fees payable in respect of the new registration number rights are less than those fees paid in respect of the cancelled registration number rights, the difference will be refunded (minus any recovery expenses VicRoads incurs).
4. Assigning the Registration Number to a Vehicle
If your application is accepted, you do not have to have the registration number assigned to a vehicle immediately. To have the registration number assigned to a vehicle registered under the Road Safety Act 1986, you must contact VicRoads by either calling 1300 660 417 or visiting a VicRoads Customer Service Centre.
There is no charge for the first assignment of your registration number to a registered vehicle.
5. Who May Display Number Plates
Your registration number may only be affixed to a vehicle registered in your name. If you wish to allow your registration number to be assigned to a vehicle registered to another person, you must complete a 'Transfer of Rights' agreement and return this document to VicRoads. A registration number in the name of an incorporated body may only be assigned to a vehicle registered in that name.
Note: It is an offence under section 16 of the Road Safety Act 1986 to display a number plate on a vehicle that has not been assigned to that vehicle by VicRoads.
Note: If you are intending to have a car dealer attach a number plate or plates to your vehicle, ensure they remain in the box provided by VicRoads, and take the whole package to the dealer as there is information affixed to the box to assist dealers when registering your vehicle.
6. Seizure of Number Plates
An authorised officer of VicRoads or a member of the police force may seize a number plate if he or she reasonably suspects that it is not being used, or was not issued, in accordance with the Road Safety Act 1986 or regulations.
He or she may also seize a number plate displayed on a motor vehicle or trailer if he or she reasonably suspects that the motor vehicle or trailer:
- has a different registration number to that shown on the plate; or
- ought to be registered, but is not registered or its registration has lapsed.
Seized plates may be retained until VicRoads or the police officer is satisfied that the above matters have been addressed.
7. Privacy Statement
Personal information we collect from you in connection with your application or the registration of your vehicle will be used for those purposes and may be used for other purposes permitted by the Road Safety Act 1986.
Your personal information may be disclosed to contractors and agents of VicRoads, law enforcement agencies, other road, traffic authorities, the Transport Accident Commission, vehicle manufacturers (for safety recalls only), courts and other organisations authorised to collect it. You are required to provide this information if you wish to obtain a customised registration plate in accordance with the Road Safety Act 1986.
Failure to provide the information may result in your application not being processed or records not being properly maintained. 8. Governing Law
If VicRoads accepts your application, the contract formed will be governed by the laws of Victoria, Australia. Both you and VicRoads agree to submit to the non-exclusive jurisdiction of its courts and courts of appeal from them and must not object to the exercise of jurisdiction by those courts on any basis.
9. Warranties, Conditions, Descriptions or Representations
The number plate or plates bearing the registration number nominated by you are provided, to the extent permitted by law, without any warranty, condition, description or representation in relation to the state, quality or fitness for purpose of the plates.
If any condition, warranties, descriptions or representations are implied into this sale by law, the liability of VicRoads is limited, at its absolute discretion, to re-issuing the plates, or offering you the option of being issued with a refund or applying for new registration rights in accordance with clause 9 of these terms and conditions of sale.
10. Loss of Rights to a Registration Number
Registration number rights are cancelled on the expiry of the period of 12 months of the vehicle to which the relevant registration number was last assigned continuing to be unregistered, unless you notify VicRoads before such expiry of your wish to retain the relevant registration number.
11. Selling Your Vehicle
If you sell the vehicle with the number plate or plates attached, it will be presumed that you have also sold the registration number rights to the purchaser of the vehicle (unless there is evidence to the contrary).
If you wish to sell the vehicle but retain the registration number rights, you will need to retain the number plate or plates bearing the registration number, have another registration number assigned to the vehicle and have the appropriate number plate or plates issued. Regulated fees may apply.
12. Transferring the Registration Rights
Should you wish to transfer your registration number rights to another person, you are required to complete a Transfer of Rights form and provide it to VicRoads. This form is on the instruction sheet with your new plates and is available from VicRoads Customer Service Centres or online by visiting the VicRoads website and clicking on the menu option "Registration" then "Number Plates" and selecting "Number Plates - Transfer of Rights".
13. Storage of Number Plates
If your registration number has not been assigned to a vehicle, you must keep the number plate or plates bearing that registration number in a secure location, and do everything you reasonably can to prevent the loss, destruction, theft or other unauthorised use of the number plate or plates, and comply with any reasonable directions of VicRoads in relation to the storage of them. More particularly, you must not allow the number plate or plates to be affixed to a vehicle unless VicRoads has assigned the registration number to that vehicle.
